Before you build

Land due diligence in Bali before you buy or lease a plot to build on

The best villa design is worthless on land that cannot be built on. Land due diligence confirms who owns the plot, what the zoning allows and whether a PBG is realistic, before money moves.

Land due diligence in Bali answers two questions before you buy or lease a plot: is the title clean, and can you build what you want on it? The first is a land office question. The second is a zoning and permit question, and it is the one buyers skip. A plot with a perfect certificate can still sit in a green zone where a villa will never get a PBG. We check both, so the land you pay for can carry the building you plan.

Cost: quoted per plot before work starts, with government search fees on a separate line.

Title checks at the land office

  • Authenticity. The certificate is checked at the BPN land office against the land book.
  • Owner. The name on the certificate is matched with the seller's or lessor's KTP. If the owner has died, the certificate should have been updated and the heirs identified.
  • Encumbrances. The SKPT shows mortgages, liens, court blocks and disputes.
  • Customary and inherited land. Who must consent, including every heir for a lease extension later.

Zoning: can a villa be built here?

Each regency's spatial plan (RTRW) sets what land may be used for. In everyday Bali terms:

  • Green zones are held mainly for agriculture, forestry and conservation. Development is heavily restricted, and some agricultural land cannot be developed at all.
  • Yellow zones allow housing.
  • Other zone colours and green belts carry their own limits, and the plan for the exact plot decides.

We read the zoning for the exact plot, not the neighbourhood. A neighbour's villa is not proof that yours will be approved. If the zoning does not fit, you hear it now, not after the architect's invoice.

Boundaries and access

A survey confirms that the plot on the ground matches the certificate and that it has legal road access. In rice field areas some plots are reached only along a field path, so legal access is worth confirming before you pay.

Holding the land as a foreigner

Foreigners cannot hold freehold (Hak Milik). The usual routes are a notarised lease with a clear extension mechanism, a Hak Pakai for KITAS or KITAP holders, or HGB through a PT PMA. Nominee arrangements, where an Indonesian holds land for a foreigner, are void, and the money paid cannot be recovered.

After the checks

If the land is clean and the zoning fits, the next step is the PBG. If there is already a building on the plot, add villa due diligence to check its permits.

Questions people ask

What does land due diligence in Bali cover?

The certificate checked at the BPN land office, the registered owner and any heirs, mortgages and disputes, zoning under the regency spatial plan, boundaries and legal access, unpaid land tax and the draft contract.

What is a green zone in Bali?

Land reserved mainly for agriculture, forestry or conservation in the regional spatial plan. Building there is heavily restricted, so a villa project on green zone land usually cannot get a PBG.

Can a green zone be changed to a yellow zone?

Zoning changes go through the regency planning authority and its spatial plan, may need an environmental study and public consultation, and can take several months. They are never guaranteed, so do not pay on the promise of one.

Can a foreigner buy land in Bali?

Not as freehold. Foreigners use a lease, a Hak Pakai with a KITAS or KITAP, or HGB through a PT PMA. Nominee arrangements are void under Indonesian law.

How long does land due diligence take?

Generally a few weeks, because the land office and other government checks take time.
